Terms of Service

Welcome to AblePath. These Terms of Service ("Terms") govern your use of the AblePath software platform, which is provided to Supported Living Services organizations ("Customer Organizations") in California.
AblePath is a Software Platform Provider
AblePath provides software tools to Customer Organizations. Your employer or care provider (the Customer Organization) has contracted with AblePath to use our platform. AblePath does not employ you, manage your work, or control how Customer Organizations use the platform.
By accessing or using AblePath, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using AblePath, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and AblePath.
2. Description of Service
AblePath provides a software platform to Customer Organizations. Features may include:
- Time and Attendance with Electronic Visit Verification (EVV)
- Schedule Management and shift assignments
- Client Care documentation and service notes
- Medication Administration Records (MAR) tracking
- Special Incident Report (SIR) documentation
- Mileage tracking for client transportation
- Communication and messaging features
Customer Organizations determine which features to use and how to configure them for their staff.
3. Account Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Never sharing your account with another person
- Immediately notifying your administrator of unauthorized use
- Logging out when using shared or public devices
4. Employment Relationship
AblePath is a technology platform. Your use of AblePath does not create an employment relationship with AblePath. Your employment relationship is with your employer organization, and all employment matters (wages, benefits, discipline) are governed by your employer's policies.
5. Time Tracking Features
The platform includes time tracking features. Your Customer Organization sets the policies for how you must use these features. Generally, Customer Organizations require staff to:
- Record all work time accurately and honestly
- Clock in only when you begin providing services
- Clock out immediately when you stop providing services
- Never clock in or out on behalf of another employee
- Report time record errors to your supervisor immediately
Contact your Customer Organization for their specific time tracking policies.
6. Accurate Information
You agree to provide accurate information when using the platform. Falsifying records (including time entries, service documentation, or other data) may violate your Customer Organization's policies and applicable laws. Consequences for falsifying records are determined by your Customer Organization and may include:
- Disciplinary action up to termination
- Repayment of improperly claimed wages
- Legal consequences under applicable laws
7. Confidentiality
You may access sensitive information through the platform. Your Customer Organization is responsible for HIPAA compliance and will provide you with their confidentiality policies. You agree to follow your Customer Organization's policies regarding:
- Accessing only information necessary for your job duties
- Protecting client information from unauthorized disclosure
- Reporting suspected privacy breaches to your Customer Organization
8. Acceptable Use
You may use AblePath only for:
- Legitimate work-related purposes
- Accessing client information necessary for assigned care
- Communicating professionally with all users
- Completing documentation accurately and timely
9. Prohibited Activities
- Violating any applicable laws or regulations
- Accessing information about unassigned clients
- Sharing or distributing client information improperly
- Harassing, threatening, or abusing other users
- Transmitting malware or harmful code
- Falsifying any information or documentation
- Impersonating another person
10. Intellectual Property
AblePath and all related content are owned by AblePath and protected by intellectual property laws. You receive a limited, non-exclusive, revocable license to use the app solely for work purposes. This license terminates when your account or employment ends.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. AblePath is a documentation tool and does not provide medical advice. We do not guarantee the Service will be available at all times or error-free.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABLEPATH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Our total liability shall not exceed $100.
13. Dispute Resolution
For employment-related disputes: Contact your Customer Organization directly. AblePath is not your employer and cannot resolve employment matters.
For platform-related disputes with AblePath:
- Contact support@ablepath.app first to resolve disputes informally
- Unresolved disputes subject to binding arbitration in Mendocino County, CA
- California law governs these Terms
14. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting updated Terms in the app. Continued use after changes constitutes acceptance of modified Terms.
